11. Limitation on Guidance Given to Client: Client understands and agrees that the consultants are not licensed or trained as doctors, therapists, psychologists or any other similar professionals. The consultants are never intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical or psychological condition. Never disregard professional medical advice or delay in seeking it because of something you have read, heard or experienced during a Wholenomics Pte. Ltd. program. The information and processes taught by Wholenomics Pte. Ltd and shared on our Site are real and work. However, Wholenomics Pte. Ltd. cannot, in any good conscience, guarantee any outcome of financial gain and/or success from any programs, events, services, or information provided on our Site and associated services and materials. We can teach you everything we know, but we can’t implement it for you. As it is in life, how far you go is up to you and your ability to implement what we teach you. It’s stipulated by law and our good intentions for you that we let you know this.
12. Limitation of Liability: Wholenomics Pte. Ltd., its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, independent contractors, consultants, officers, and directors will not be liable for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary, or other damages, including loss of revenue or income, loss of data, pain and suffering, emotional distress, or similar damages, even if Wholenomics Pte. Ltd. has been advised of the possibility of such damages, such damages were reasonably foreseeable or Wholenomics Pte. Ltd. was grossly negligent. In no event will the collective liability of Wholenomics Pte. Ltd. and its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, and directors, regardless of the form of action (whether in contract, tort, or otherwise), exceed the greater of $100 or the amount you have paid to Wholenomics Pte. Ltd. for the use of the Site or any service it provides. Making decisions based on any information presented in our products, events, services, or Site, should be done only with the knowledge that you could experience risk or losses just like any entrepreneurial endeavor. Governing law, Venue: If there is any dispute arising out of or in connection with the use of this Site, any services provided, or these Terms of Use, such dispute shall be governed by and construed in accordance with the laws of Singapore, without regard to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the courts of Singapore, and that any claims or legal proceedings must be instituted in a court of competent jurisdiction in Singapore. To the extent permitted by applicable law, you agree that any claim or cause of action arising out of or related to the use of this Site or these Terms must be filed within one (1) year after such claim or cause of action arose or be permanently barred.
15. Severability: If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.
16. Waiver: The failure of Wholenomics Pte. Ltd. to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. Any waiver of this Agreement by Wholenomics Pte. Ltd. must be in writing and signed by an authorized representative of Wholenomics Pte. Ltd.
17. Termination: Wholenomics Pte. Ltd. may terminate this Agreement at any time, with or without notice, for any reason.
18. Relationship of the Parties: Nothing contained in this Agreement or your use of the Site shall be construed to constitute either party as a partner, joint venturer, employee or agent of the other party, nor shall either party hold itself out as such. Neither party has any right or authority to incur, assume or create, in writing or otherwise, any warranty, liability or other obligation of any kind, express or implied, in the name of or on behalf of the other party, it being intended by both parties that each shall remain independent contractors responsible for its own actions.
19. Payment and delivery: We accept the following payment methods as a minimum: Visa, MasterCard, Net banking. With our consulting packages, you are automatically signed up for payment through a third-party service. This means that an agreed-upon amount will be withdrawn in the agreed-upon fixation and the amount of time you are active. The Service Provider we use is Wise, a leading payment system globally. Upon signup, the necessary details will be transmitted through the external use of industry-standard TLS encryption to ensure your information remains secure. By accepting these, you grant permission to send instructions to the financial institution that issues your card in accordance with the terms of your agreement. The amount is deducted prior to your purchased service, regardless of whether it is Personal Consulting or Group Consulting being delivered in-person or online. The Service Provider will never be able to withdraw a larger amount than you have approved at the time of purchase. Prices are quoted in USD. You are responsible for any bank or currency conversion fees.
20. Refund Policy: The fees payable in respect of the products and services will be clearly communicated to you prior to the commencement of the program. Once you sign up and pay the requisite fees for the program, cancellation of the subscription is not allowed. We offer a goodwill refund of the program fee after the first session if you are dissatisfied, provided you submit your request within 6 calendar days of completing your first session. No refunds will be provided thereafter under any circumstances.
21. Rescheduling of Sessions: Once a session is booked, any rescheduling will be subject to our sole discretion.
22. Entire Agreement: These Terms of Use together with our Privacy Policy and Cookie Policy constitutes the entire agreement between you and Wholenomics Pte. Ltd.

We may use your e-mail address and phone number to contact you regarding administrative notices, new product offerings, and communications relevant to your use of the Site. You will have the ability to not receive such advertisements, promotions, notices and information by contacting Wholenomics and requesting to no longer receive such notices.
(d) Dispute Resolution. We may use information in the file we maintain about you, and other information we obtain from your current and past activities on the Site, to resolve disputes, troubleshoot problems and enforce our Terms and Condition Agreement.
